MyGlobalCFO (Pty) Ltd in South Africa is responsible for the operation and administration of this website. MyGlobalCFO Pty Ltd is separately responsible for the Australian financial services it provides and for representations made on its behalf in connection with those services. Responsibility for website operation does not, of itself, make the South African entity the provider of Australian financial services.

This website contains information about services provided by two separate legal entities: MyGlobalCFO (Pty) Ltd in South Africa, an FSCA Authorised Financial Services Provider (FSP No. 49859), and MyGlobalCFO Pty Ltd in Australia (ACN 631 874 050), holder of Australian Financial Services Licence No. 700155.

The entity responsible for a particular service depends on the service and jurisdiction involved. These entities are separate legal persons and are subject to different regulatory regimes.

Which terms apply?

This page contains South African Website Terms and additional Australian provisions. They concern website use and public information, not the terms on which you engage either entity to provide services. The applicable provisions depend on the entity, service and website content concerned, not solely on where you access the website.

The South African section applies to website use relating to MyGlobalCFO (Pty) Ltd and its South African activities. Within that section, “MyGlobalCFO” refers to the South African entity, and references to “this website”, its content and information relate to those activities. Its FAIS, FICA, compliance-officer and complaints provisions concern the South African entity and its services only.

The Australian provisions concern MyGlobalCFO Pty Ltd and its Australian activities, including Australian-facing services and website content. The South African FAIS, FICA, compliance-officer and complaints provisions do not apply to that entity or its services.

For the avoidance of doubt, references in the South African Website Terms to legal process, notices or services arising from use of this website do not determine the governing law, jurisdiction or service address applicable to any agreement with MyGlobalCFO Pty Ltd. Those matters are governed by the applicable client agreement and mandatory law.

Where content relates to both entities, each section applies to its respective entity’s activities. If the South African wording conflicts with the Australian provisions in relation to Australian activities, the Australian provisions take precedence for those activities.

Nothing in these Website Terms excludes, restricts or modifies any mandatory right, remedy, guarantee or obligation under applicable law. These Website Terms do not replace or amend service-specific client agreements or required disclosures. Updates to these Website Terms apply prospectively and do not retrospectively amend existing client agreements or affect accrued rights or remedies.

• The content of this website is the property of MyGlobalCFO. It is protected by copyright law, and website users acknowledge that they have no rights to any of the content.
• This website and the use thereof is governed by the law in force in South Africa. Users acknowledge the jurisdiction of South African courts.

• Should you have a complaint about the financial services rendered by MyGlobalCFO or one of its representatives, this should be lodged in writing along with supporting documentation.  This can be emailed to info@myglobalcfo.com.  MyGlobalCFO will ensure that your complaint is acknowledged, and it will be addressed within six weeks.  In the event that a complaint cannot be resolved, the complainant may refer the matter to the FAIS Ombud.

• MyGlobalCFO is committed to protecting the privacy of users. • MyGlobalCFO is an accountable institution in terms of FICA (Financial Intelligence Centre Act of 2001) and may be obliged to report suspicious or unusual transactions that may be used to facilitate money laundering.
• MyGlobalCFO does not make any representations or guarantees about the security of information sent electronically. Users acknowledge the risks of online transfer of information and acknowledge that information is sent and received at the risk of the sender. No warranties are given with regards to freedom of the website or any links from viruses or malware.

These additional provisions concern MyGlobalCFO Pty Ltd and its Australian services and website information. In this section, “we”, “us” and “our” refer to the Australian entity, not the South African website operator. These provisions do not replace Australian client agreements or required disclosures.

Entity and financial services

Relevant Australian financial services are provided through MyGlobalCFO Pty Ltd, ACN 631 874 050, holder of Australian Financial Services Licence No. 700155, within the scope of its authorisations.

Where personal financial advice is provided, it is provided through the appropriate Australian client process and within the scope of the applicable authorisations.

Required financial services disclosures, including a Financial Services Guide where applicable, will be provided or made available in accordance with Australian law. These Website Terms are not a Financial Services Guide or a substitute for required advice warnings or disclosures.

Public website information

Unless expressly stated otherwise, information made publicly available on this website relating to our Australian activities is general in nature.

Complaints concerning our Australian services are handled under the Australian complaints process. For information about making a complaint, please see our Complaints & Dispute Resolution page. The South African complaints process does not apply to Australian service complaints.

Applicable law and changes

The South African governing-law, court and legal-notice provisions do not govern our Australian activities. Mandatory Australian rights and remedies remain unaffected. Services provided by MyGlobalCFO Pty Ltd may be subject to separate agreements containing jurisdiction-specific governing-law and dispute-resolution provisions.

We may update these Australian provisions from time to time. The current version will be published on this page.

Updates to these Australian provisions apply prospectively and do not retrospectively alter accrued rights or remedies. Changes to these Website Terms do not amend an existing client agreement unless that agreement expressly provides otherwise.
